WORK HEALTH AND SAFETY ACT 2012.
- The main object of this Act is to provide for a balanced and nationally consistent framework to secure the health and safety of workers and workplaces by –
- (a) protecting workers and other persons against harm to their health, safety and welfare through the elimination or minimisation of risks arising from work or from specified types of substances or plant; and
- (b) providing for fair and effective workplace representation, consultation, cooperation and issue resolution in relation to work health and safety; and
- (c) encouraging unions and employer organisations to take a constructive role in promoting improvements in work health and safety practices, and assisting persons conducting businesses or undertakings and workers to achieve a healthier and safer working environment; and
- (d) promoting the provision of advice, information, education and training in relation to work health and safety; and
- (e) securing compliance with this Act through effective and appropriate compliance and enforcement measures; and
- (f) ensuring appropriate scrutiny and review of actions taken by persons exercising powers and performing functions under this Act; and
- (g) providing a framework for continuous improvement and progressively higher standards of work health and safety; and
- (h) maintaining and strengthening the national harmonisation of laws relating to work health and safety and to facilitate a consistent national approach to work health and safety in this jurisdiction.
- In furthering subsection (1)(a), regard must be had to the principle that workers and other persons should be given the highest level of protection against harm to their health, safety and welfare from hazards and risks arising from work or from specified types of substances or plant as is reasonably practicable.
WORK HEALTH AND SAFETY REGULATIONS 2012.
The Work Health and Safety Regulations 2012 have stipulated that all workplaces must have an Emergency Plan to ensure that all persons who may be in a building when an emergency occurs are as safe as they can be.
Section 43 – Duty to prepare, maintain and implement emergency plan
(1) A person conducting a business or undertaking at a workplace must ensure that an emergency plan is prepared for the workplace, that provides for the following:
(a) emergency procedures, including –
(i) an effective response to an emergency; and
(ii) evacuation procedures; and
(iii) notifying emergency service organisations at the earliest opportunity; and
(iv) medical treatment and assistance; and
(v) effective communication between the person authorised by the person conducting the business or undertaking to coordinate the emergency response and all persons at the workplace;
(b) testing of the emergency procedures, including the frequency of testing;
(c) information, training and instruction to relevant workers in relation to implementing the emergency procedures.
Penalty:
In the case of –
(a) an individual, a fine not exceeding $6 000; or
(b) a body corporate, a fine not exceeding $30 000.
(2) A person conducting a business or undertaking at a workplace must maintain the emergency plan for the workplace so that it remains effective.
Penalty:
In the case of –
(a) an individual, a fine not exceeding $6 000; or
(b) a body corporate, a fine not exceeding $30 000.
(3) For the purposes of subregulations (1) and (2), the person conducting the business or undertaking must consider all relevant matters, including the following:
(a) the nature of the work being carried out at the workplace;
(b) the nature of the hazards at the workplace;
(c) the size and location of the workplace;
(d) the number and composition of the workers and other persons at the workplace.
(4) A person conducting a business or undertaking at a workplace must implement the emergency plan for the workplace in the event of an emergency.
Penalty:
In the case of –
(a) an individual, a fine not exceeding $6 000; or
(b) a body corporate, a fine not exceeding $30 000.
TASMANIA FIRE SERVICE.
The TFS General Fire Regulations detail what each building owner or occupier must have in place in regards to fire safety obligations imposed on them by the Fire Service Act 1979 and the General Fire Regulations 2021 . These obligations are primarily aimed at providing for the safety of building occupants and fire-fighters in the event of a fire occurring in a building, and to minimise the spread of fire.
TFS are the regulatory authority for fire safety in Tasmania and they have mandated the AUSTRALIAN STANDARDS 3745/2010 (Planning for emergencies in facilities) and 4083/2010 (Planning for emergencies in Health Care facilities) which means that any person conducting a business or undertaking in Tasmania must ensure they comply with the applicable Australian Standards.
AUSTRALIAN STANDARDS.
AS1851 -2012 – This Standard details what testing and servicing is required for all Fire Fighting and Fire Safety Equipment in commercial buildings.
AS3745-2010 (Preparing for emergencies in Facilities).
This Standard sets out what is required to be in the Emergency Plan when it is developed for any non-Health Care Buildings and what it must contain.
AS4083-2010 (Preparing for emergencies in Health Care Facilities).
This Standard sets out what is required to be in the Emergency Plan when it is developed for Health Care Buildings and what it must contain.
The above Acts, Regulations and Standards have been mandated by the Tasmanian Government therefore any person conducting a business or undertaking in Tasmania must ensure they comply with the Act & Regulations by having in place an Emergency Response Plan.
WORKSAFE TASMANIA.
WorkSafe Tasmania have made it compulsory for every workplace in Tasmania to comply with the Building Act 2016, Director’s Maintenance of prescribed Essential Building Services Determination and have a Schedule of Maintenance in place.
For the purposes of Part 14 of the Building Act 2016 and Part 7 of the Building Regulations 2016 this Determination specifies:
(a) the prescribed Essential Building Services required to be maintained; and
(b) the required frequency of testing, inspection or maintenance of those Essential Building Services.
